Guilty plea entered by Poeverlein

A Jefferson County man has pleaded guilty to reckless aggravated battery and aggravated assault.
Bryan E. Poverlein, 24, reached the deal last week and will be sentenced Aug. 18.
Poverlein had faced a second degree attempted murder charge that was reduced to reckless aggravated battery after he shot his half-brother.
Jefferson County Sheriff’s deputies were called to a residence near the 1600 block of Wellman Road on Feb. 17 in the late night-early morning hours and found a man shot.
Poverlein was arrested and has been housed in the Jefferson County jail since. His brother is still recovering from his injuries.
According to Jefferson County Prosecutor Robert Fox, Poverlein and his half-brother lived in the home with their biological mother. Poverlein was upset with the brother because some dishes had not been washed.
Poverlein became angry and called his brother. The brother came home along with a friend and an argument escalated. Poverlein then grabbed a gun and fired two shots. One shot went into the floor and another bullet struck the victim.
No agreement was reached between Fox’s office and Poverlein. His attorney, Sarah Swain, will argue for probation. Fox will argue for prison time. Poverlein could face more than 11 years in prison.
